DURBAN – In a development that has sent shockwaves across South African social media platforms, popular digital creator and TikTok influencer Max Makhanya has been arrested by law enforcement authorities in KwaMashu.
The high-profile arrest follows the widespread circulation of a controversial video in which Makhanya reportedly hurled insults and directed harsh criticism toward KwaZulu-Natal Provincial Police Commissioner, Lieutenant-General Nhlanhla Mkhwanazi.
The incident unfolded rapidly after Makhanya uploaded a video onto his TikTok account targeting the provincial police chief. In the digital footage, Makhanya explicitly questioned the leadership capability of General Mkhwanazi, accusing the police service of failing to protect citizens and allowing instances of community abuse to go unaddressed.
Although Makhanya quickly removed the video from his official page after realizing the gravity of his statements, the digital footprint had already been established.
Screen-recorded copies of the clip quickly went viral across Facebook, YouTube, and WhatsApp groups, drawing the immediate attention of the South African Police Service (SAPS).
Eyewitness accounts and video snippets capturing the moment of the arrest showcase a tense confrontation between Makhanya and heavily armed tactical police officers in KwaMashu.
In the footage of the apprehension, law enforcement officials can be heard commanding Makhanya to get down on the ground, to which the subdued social media figure responded by complying with the directives.
The arrest has ignited an intense nationwide debate regarding the boundaries of free speech, digital accountability, and the legal consequences of crimen injuria in South Africa.
While several community members and social media users supported the swift action by the police—arguing that public figures must be deterred from undermining the integrity of senior law enforcement officials—others raised concerns regarding state overreach and the perceived suppression of public frustration.
This high-profile arrest comes at a critical juncture for Lieutenant-General Nhlanhla Mkhwanazi. Widely regarded as a no-nonsense, hardline police commander, Mkhwanazi has recently been a focal point in national security circles.
Acting Police Minister Firoz Cachalia initiated the formal processes to appoint General Mkhwanazi as the new national head of the Directorate for Priority Crime Investigation (DPCI), commonly known as the Hawks.
Given Mkhwanazi’s impending elevation to lead the country’s elite crime-fighting unit, public scrutiny surrounding his public image and the conduct of police units operating under his influence remains exceptionally high.
As it stands, formal charges against Max Makhanya are being processed by the National Prosecuting Authority (NPA).
Legal analysts suggest that Makhanya will likely face charges related to crimen injuria or public incitement, depending on the final assessment of the video content by state prosecutors. Makhanya remains in police custody and is expected to make his initial appearance before the magistrates’ court early this week.
